Terms of Service

These Terms of Service govern access to and use of CareShift Hub, including the web application, native mobile application, APIs, and related services.

By using CareShift Hub, your organization and its authorized users agree to use the service only for approved company workflows and in compliance with applicable laws, agreements, and policies.

Authorized Use

Users may use CareShift Hub for authorized company workflows, including caregiver management, scheduling, compliance document handling, notifications, account security, reporting, and related operations.

Users must not:

  • Access another tenant's data.
  • Share credentials, MFA codes, recovery codes, or tokens.
  • Upload malicious files.
  • Upload documents they are not authorized to provide.
  • Attempt to bypass security, audit, billing, retention, or tenant isolation controls.
  • Use the service for unlawful, abusive, or unauthorized purposes.
Customer Responsibilities

The customer organization is responsible for:

  • User account approvals and role assignments.
  • Verifying caregiver data and documents.
  • Maintaining lawful basis for data processing.
  • Ensuring users are trained and authorized.
  • Configuring company settings correctly.
  • Complying with employment, healthcare, privacy, retention, and recordkeeping obligations that apply to the customer.
Sensitive Data and Compliance

CareShift Hub may process sensitive personal information, compliance records, and healthcare-related operational data. Customers must not upload data unless they have authority to do so.

If HIPAA or similar healthcare privacy obligations apply, use of the service may require a separate Business Associate Agreement or equivalent contractual terms. If required terms are not executed, customers must not use the service to process PHI or ePHI.

Availability and Support

Availability targets, support response times, maintenance windows, and service credits, if any, are defined in the applicable order form, subscription agreement, or service-level agreement.

Data Retention and Deletion

Data is retained and deleted according to the applicable customer agreement, privacy policy, data retention policy, document retention policy, legal holds, and applicable law.

Security

CareShift Hub uses administrative, technical, and organizational safeguards. No system can guarantee absolute security. Customers and users must promptly report suspected unauthorized access or security incidents.

Third-Party Services

CareShift Hub may use hosting, storage, email, SMS, billing, analytics, crash reporting, and security providers to operate the service.

Suspension

Access may be suspended for security risk, non-payment, misuse, legal requirement, or material violation of these Terms.

Disclaimers and Limitations

CareShift Hub is provided according to the applicable subscription agreement, order form, or written contract. To the maximum extent permitted by law, warranties, liability limits, and remedies are governed by those agreements and applicable law.
